Emma & Owen Vancouver respects the intellectual-property rights of others and expects our users to do the same. This policy explains how to report content you believe infringes your copyright, and how the process works. It provides general information and is not legal advice; where relevant, we follow the principles of the U.S. Digital Millennium Copyright Act (17 U.S.C. §512) and Canada’s notice-and-notice regime under the Copyright Act.
1. How to submit a notice of infringement
If you believe material on our site infringes a copyright you own or control, please email support@emmaowen-vancouver.com with a written notice that includes: (a) identification of the copyrighted work you claim has been infringed; (b) identification of the material you claim is infringing and its location (URL); (c) your contact details (name, address, email, phone); (d) a statement that you have a good-faith belief the use is not authorised by the owner, its agent, or the law; (e) a statement, made under penalty of perjury, that the information is accurate and that you are the owner or authorised to act on the owner’s behalf; and (f) your physical or electronic signature.
2. Notices made in bad faith
Please note that submitting a false or misleading infringement claim may expose you to liability for damages, including costs and legal fees, under applicable law. If you are unsure whether material infringes your rights, we recommend seeking legal advice before submitting a notice.
3. Counter-notification
If your content was removed and you believe this was a mistake or misidentification, you may submit a counter-notification to the same email address, including your contact details, identification of the removed material and its former location, and a statement, under penalty of perjury, that you have a good-faith belief the material was removed in error. Where appropriate, removed material may be restored within roughly 10–14 business days unless the original complainant pursues legal action.
4. Repeat infringers
We may, at our discretion and in appropriate circumstances, restrict or terminate access for users who are found to be repeat infringers.
